Terms of Service

Please read these Terms of Service carefully before using AFH Network. AFH Network is an operations platform for Washington State Adult Family Homes that combines a public training marketplace with subscription tools for running a home — including medication administration records (MAR), the Negotiated Care Plan (NCP) Generator, the Compliance Assistant, the Task Tracker, and seat-based employee management. By creating an account or accessing any part of the platform, you agree to be bound by these terms. If you do not agree, do not use AFH Network.

1.Acceptance and Eligibility

1.1 Acceptance

By registering for an account, purchasing a course, or otherwise using AFH Network ("the Platform"), you agree to these Terms of Service and our Privacy Policy. These Terms form a binding legal agreement between you and AFH Network.

1.2 Eligibility

  • You must be at least 18 years of age to create an account or make a purchase.
  • You must provide accurate and complete registration information.
  • Payment services are available to users in the United States only. International users may access free content if available but cannot process purchases.

1.3 Account types

  • Public users: Create a free account, browse the course catalog, purchase courses individually.
  • Students (employees): Registered via employer (owner) invitation, access courses assigned by their employer.
  • Owners (employers): Manage a business account, invite employees, request course access, track employee progress.

2.Account Registration and Security

2.1 Account creation

You may register using an email address and password, or via Google OAuth. Each person may hold only one account. Creating multiple accounts is prohibited.

2.2 Account security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must not share your username, password, or account access with any other person.
  • Seat-based access: If you are a student assigned courses by your employer, your account is personal to you. Your employer's seat allocation covers your individual access — sharing your credentials defeats the purpose of the seat-based model and violates these Terms.
  • You must notify us immediately through our contact form if you suspect unauthorized access to your account.
  • AFH Network will not be liable for any loss caused by unauthorized use of your account resulting from your failure to keep credentials secure.

2.3 Account accuracy

You agree to keep your account information (name, email) accurate and up to date.

3.Course Access and License

3.1 License grant

When you purchase a course or are granted access by your employer, AFH Network grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and use the course content solely for your own personal educational purposes.

3.2 What your license includes

  • Access to all lessons, slides, quizzes, and materials within the licensed course(s)
  • The ability to progress through the course at your own pace
  • Your progress is saved automatically
  • Access continues as long as your account is active and in good standing

3.3 Purchased courses vs. assigned courses

If you are an employee and your employer revokes your course access, you will no longer be able to access those courses. Purchased courses you have bought personally are not affected by employment changes.

3.4 No downloads

Course content (videos, slides, audio, PDFs) may not be downloaded, copied, or saved outside the platform unless explicitly stated otherwise.

4.Subscriptions and Recurring Billing

Adult Family Home owners may subscribe to a plan that unlocks operational tools. The following terms apply to all owner subscriptions. Subscription terms are separate from one-time course purchases, which are covered in Section 10 (Payments and Billing) and the Refund Policy.

4.1 Plans and what they unlock

Each plan grants access to a defined set of features. A tool is available to you only while you hold an active plan that includes that feature. Current plans, the features each plan includes, and pricing are listed on our pricing page. We do not list subscription prices in these Terms; the price shown at checkout for your selected plan is the price you will be charged.

4.2 Automatic renewal and billing cycle

  • Subscriptions are billed in advance on a recurring monthly or annual cycle, depending on the plan you choose.
  • Your subscription renews automatically at the end of each billing period at the then-current price, using your saved payment method, until you cancel.
  • You can view your current plan, renewal date, payment method, and billing history at any time from Dashboard → Subscription.

4.3 Free trials

Some plans may offer a free trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid plan and your payment method will be charged at the end of the trial. We will send a reminder before a trial ends. Only one trial is available per account.

4.4 Upgrades and downgrades

  • Upgrades take effect immediately. When you upgrade, you are billed a prorated amount for the remainder of the current period right away (your new plan is invoiced immediately with proration).
  • Downgrades are queued and take effect at the start of your next billing period. You keep access to your current plan's features until then, and no proration credit is issued for the unused portion of the higher plan.

4.5 Price changes

We may change subscription prices. If we change the price of a plan you are subscribed to, we will give you advance notice by email before the change applies to your next renewal. If you do not agree to the new price, you may cancel before your next renewal date.

4.6 Failed payments, retries, and past-due grace

  • If a renewal payment fails, our payment processor (Stripe) will automatically retry the charge over a period of approximately three weeks ("Smart Retries"), and we will email you about the failed payment.
  • Past-due grace: While your subscription is past due and retries are in progress, you keep full access to your plan's features so your operations are not interrupted.
  • Unpaid state: If all retries fail, your subscription becomes unpaid and access to the subscription tools is paused. Your data is preserved, not deleted. You can restore access at any time by clearing the outstanding balance from Dashboard → Subscription (pay outstanding invoice).

4.7 Cancellation

You may cancel your subscription at any time from Dashboard → Subscription. Cancellation takes effect at the end of your current billing period (cancel-at-period-end): you keep access to your plan's features until the period ends, and you are not billed again. Cancelling does not automatically refund the current period. Refund eligibility for subscriptions is described in our Refund Policy.

5.Owner / Business Accounts and Owner Tools

5.1 Owner responsibilities

If you register as a business owner or are invited as an owner, you are responsible for:

  • Ensuring your employees comply with these Terms of Service
  • Managing your employee roster and removing employees who leave your organization
  • Accurately representing the number of employees requiring access when requesting seats
  • Not inviting users who are not genuine employees of your Adult Family Home business

5.2 Seat-based access

  • Seat allocations are granted by AFH Network administrators
  • You may request additional seats from your dashboard; requests are subject to approval
  • Unused seats do not roll over to the next period and cannot be transferred
  • Employees access courses through your assigned course list, not independently

5.3 Employee data

As an owner, you may view your employees' course progress. You represent that you have the right to process your employees' progress data in accordance with applicable employment laws. AFH Network is a data processor on your behalf for this information.

5.4 Owner tool access requires an active plan

  • Access to an operational tool (MAR, NCP Generator, Compliance Assistant, or Task Tracker) requires an active subscription on a plan that includes that specific feature. If your plan does not include a feature, that tool is not available to you.
  • If you cancel your subscription, access to the subscription tools continues until the end of your current paid period (as described in Section 4), and then ends. If your subscription instead becomes unpaid (a lapsed or failed payment), access is suspended as described in Section 4, while your data is preserved and remains recoverable as described in that section.
  • Employees inherit course access only. When you add an employee to a seat, they receive access to the courses you assign to them. Employees never gain access to the owner tools (MAR, NCP, Compliance, or Task Tracker), regardless of your plan. Courses you purchase individually for yourself are not shared with your employees.

6.Protected Health Information and Business Associate Status

6.1 Resident data you enter

When you use the MAR and NCP Generator tools, you may enter or upload resident information that constitutes Protected Health Information ("PHI"), including resident names, medications, care plans, and related health details. You are responsible for ensuring you have the lawful authority to provide this information to us and to process it through the platform.

6.2 Our role

With respect to resident PHI, you (the owner / covered Adult Family Home) act as the controller of that data, and AFH Network acts as a service provider and business associate processing the data on your behalf and at your direction to provide the tools. We do not use resident PHI for any purpose other than providing and maintaining the service.

6.3 Business Associate Agreement

Resident PHI processed through AFH Network is handled under a Business Associate Agreement (BAA) with Microsoft Azure, which provides the AI and document-processing infrastructure for the MAR and NCP tools. Uploaded care-plan documents are sent directly to private Azure storage and are deleted after processing. Your use of the PHI-handling tools is subject to the terms of the applicable BAA and to your own obligations under HIPAA and Washington State law.

6.4 Your compliance responsibilities

  • You are responsible for obtaining any consents and meeting all legal requirements that apply to collecting, storing, and sharing resident data.
  • You are responsible for accuracy of the resident and medication data you enter, and for the security of your own account credentials and devices.
  • You must not enter or upload PHI for any person for whom you do not have lawful authority and a legitimate care relationship.

7.Compliance, Medical, and Legal Disclaimer

The Compliance Assistant, NCP Generator, and MAR are informational and administrative aids only. They are decision-support tools to help you organize and document your work. They do not provide, and must not be relied on as, legal, regulatory, medical, nursing, or clinical advice.

  • You are solely responsible for the accuracy and completeness of all data you enter, and for every care, medication, staffing, and compliance decision you make.
  • Output from these tools — including suggested care-plan content, regulatory answers, and citations — may be incomplete, out of date, or incorrect, and must be independently reviewed and verified by a qualified person before you rely on it.
  • You must verify all output against the current text of WAC 388-76 and current Washington State Department of Social and Health Services (DSHS) requirements. Regulations change, and AFH Network is not a substitute for official sources or professional judgment.
  • AFH Network is not a licensed healthcare provider, law firm, or government agency, and use of these tools does not create any professional or fiduciary relationship.

8.Artificial Intelligence Disclosure

The NCP Generator and Compliance Assistant use artificial intelligence (Azure OpenAI) to read uploaded documents, generate draft care-plan content, and answer regulatory questions. AI output is generated automatically and may be incomplete, inaccurate, or out of date. It may also miss information present in your source documents. You must review and verify all AI-generated content for accuracy and suitability before relying on it or acting on it. By using these features, you acknowledge that AFH Network does not warrant the accuracy of AI-generated output and that responsibility for the final content remains with you.

9.Acceptable Use

You agree not to:

9.1 Account and access

  • Share your login credentials with anyone else
  • Allow others to access the platform using your account
  • Create multiple accounts
  • Use another person's account without their explicit permission and AFH Network's written consent

9.2 Intellectual property

  • Copy, reproduce, distribute, or publicly display any course content
  • Screen-record, screenshot, or otherwise capture course videos, slides, or audio for redistribution
  • Create derivative works based on course content
  • Use course content to create competing products or services

9.3 Platform integrity

  • Attempt to hack, reverse-engineer, or disrupt the platform
  • Scrape or data-mine content using automated tools
  • Introduce malware, viruses, or harmful code
  • Use the platform for any unlawful purpose
  • Interfere with other users' access to the platform

9.4 Content

  • Post false, misleading, or defamatory information
  • Harass, bully, or abuse other users or AFH Network staff
  • Impersonate any person or entity

9.5 Owner tools (MAR, NCP, Compliance, Task Tracker)

  • Enter false, fraudulent, or knowingly inaccurate resident, medication, staffing, or compliance data
  • Upload or enter Protected Health Information for any person without lawful authority and a legitimate care relationship
  • Rely on tool output as a substitute for professional judgment or for verifying current regulatory requirements
  • Use the tools to misrepresent compliance status to any regulator, resident, family member, or third party

Violation of any of these prohibitions may result in immediate suspension or termination of your account without refund.

10.Payments and Billing

10.1 Prices

All course prices are displayed in US Dollars (USD). Prices are subject to change. The price shown at checkout is the price you will be charged.

10.2 Payment processing

All payments are processed by Stripe. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy. AFH Network does not store your credit card information.

10.3 Taxes

Applicable sales tax is calculated at checkout based on your billing address using Stripe's Tax API. Tax rates are determined by your location and may vary.

10.4 Billing accuracy

You represent that you are authorized to use the payment method you provide and that the billing information you submit is accurate.

10.5 Failed payments

If a payment fails, your purchase will not be completed. Contact your bank or try a different payment method. Failed subscription renewal payments are governed by Section 4 (Subscriptions and Recurring Billing), including the automatic retry, past-due grace, and recovery terms described there.

10.6 Refunds

See our separate Refund Policy for full details. By purchasing, you acknowledge and agree to our Refund Policy.

11.Intellectual Property and Data Ownership

11.1 Our content

All course content, including but not limited to text, slides, audio narration, videos, images, quiz questions, branding, and logos, is the intellectual property of AFH Network or its licensors and is protected by US and international copyright law.

11.2 Your content

You retain ownership of any personal data you provide (profile information, etc.). You grant AFH Network a limited license to store and display this information solely to provide the service.

11.3 Feedback

If you provide feedback, suggestions, or ideas about AFH Network, you grant us the right to use them without compensation to you.

11.4 DMCA

If you believe your copyright has been infringed on our platform, please contact us through our contact form with a DMCA takedown notice.

11.5 Your business and resident data

  • You retain ownership of the business and resident data you enter into the platform, including MAR records, care plans, staff and task-tracking records, and compliance history.
  • You grant AFH Network a limited license to store, process, and display your data solely to provide and maintain the service on your behalf.
  • You may export your data while your account is active. Some records, including MAR records and audit logs, are subject to a seven-year retention requirement under WAC 388-76 and may be retained for that period even after you stop using the tools, as described in Section 14 (Termination).

12.Disclaimer of Warranties

The Service — including the courses and the operational tools (MAR, NCP Generator, Compliance Assistant, and Task Tracker) — is provided for informational and educational purposes only. AFH Network provides training content aligned with Washington State DSHS caregiver education guidelines. However:

  • We are not a licensed healthcare provider and nothing in our courses constitutes medical, nursing, or clinical advice.
  • We are not a government agency and are not officially certified by DSHS. Always verify current state requirements directly with DSHS.
  • Completion of our courses does not guarantee regulatory compliance or employment outcomes.
  • The Service as a whole — including all course content and the operational tools (MAR, NCP Generator, Compliance Assistant, and Task Tracker) — is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of accuracy, completeness, merchantability, or fitness for a particular purpose.

13.Limitation of Liability

To the fullest extent permitted by law:

  • AFH Network's total liability for any claim arising from your use of the platform is limited to the total amount you paid to AFH Network for the course purchases and/or subscription fees at issue in the 12 months preceding the claim.
  • AFH Network is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
  • AFH Network is not liable for any failure or delay caused by circumstances beyond our reasonable control (force majeure).

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14.Termination

14.1 By you

You may cancel a subscription at any time from Dashboard → Subscription (cancellation takes effect at the end of the current billing period, as described in Section 4), and you may delete your account from Settings → Security → Delete Account. Account deletion is permanent. See our Refund Policy for applicable refunds upon cancellation or account closure.

14.2 By AFH Network

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. Grounds include but are not limited to:

  • Sharing login credentials
  • Copying or redistributing course content
  • Chargebacks without attempting our refund process first
  • Any fraudulent, abusive, or illegal conduct

Upon termination for cause, you forfeit access to all courses with no refund.

14.3 Effect on subscriptions and data

  • When a subscription ends (by cancellation, non-payment, or termination), access to the subscription tools stops, but your data is preserved and not immediately deleted.
  • While your account is active you may export your data, including MAR records and printable care-plan and task documents.
  • Certain records, including MAR records and audit logs, may be retained for up to seven years to meet WAC 388-76 retention requirements, even after you cancel or delete your account. Resident PHI is not simply auto-purged on account deletion where retention obligations apply.

14.4 Account security features

We provide account-security features you are encouraged to use, including two-factor authentication (2FA) with backup codes, passkeys (WebAuthn / FIDO2), and 30-day trusted-device recognition. You remain responsible for safeguarding your credentials and any devices you mark as trusted.

15.Governing Law and Dispute Resolution

15.1 Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law principles.

15.2 Informal resolution

Before filing any formal dispute, you agree to contact us through our contact form to attempt an informal resolution. We will make good-faith efforts to resolve disputes within 30 days.

15.3 Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Washington State or via remote hearing. You waive the right to a jury trial and class action participation.

15.4 Small claims

Nothing prevents either party from bringing qualifying claims in small claims court.

16.General Provisions

16.1 Entire agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and AFH Network.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

16.3 Waiver

Failure to enforce any provision does not constitute a waiver of future enforcement.

16.4 Assignment

You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.

16.5 Changes to Terms

We may update these Terms at any time. We will notify you of significant changes by email and update the "Last updated" date. Continued use after changes constitutes acceptance.
